Welcome to Spectrayan. These Terms and Conditions govern your access to and use of the Spectrayan platform, including our web application, AI assistants, and related services. By creating an account or using our services, you agree to be bound by these terms.
1. Definitions
"Platform" refers to the Spectrayan web application, AI assistants, and all related tools and services.
"Provider" refers to licensed healthcare professionals using the platform to manage client care.
"Client" refers to individuals receiving care whose information is managed through the platform.
"User" refers to any person who accesses or uses the platform, including providers, clients, and administrators.
2. Eligibility and Account Registration
To use Spectrayan, you must:
- Be at least 18 years of age, or have parental/guardian consent
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access to your account
Provider accounts require valid professional credentials. Spectrayan reserves the right to verify credentials and suspend accounts that cannot be verified.
3. Acceptable Use
You agree to use the platform only for its intended purpose — supporting behavioral health practice management and care delivery. You may not:
- Use the platform for any unlawful purpose
- Attempt to gain unauthorized access to other users' data or accounts
- Upload malicious code, viruses, or harmful content
- Misrepresent your identity, credentials, or professional qualifications
- Use AI assistants to generate content that could cause harm to clients
- Scrape, copy, or redistribute platform content without authorization
4. AI Assistant Services
Spectrayan provides four specialized AI assistants for ABA, CBT, speech therapy, and occupational therapy. By using these services, you acknowledge and agree that:
- AI is a support tool, not a replacement for clinical judgment. AI-generated recommendations are informational and should always be reviewed by a qualified professional before being applied to client care.
- No diagnostic authority. The AI assistants do not diagnose conditions, prescribe treatments, or make clinical decisions. Providers retain full responsibility for all clinical decisions.
- Data privacy. Your personally identifiable information is not used to train or fine-tune AI models. See our Privacy Policy for full details.
- Accuracy limitations. While we strive for accuracy, AI-generated content may contain errors. Spectrayan is not liable for decisions made based on AI output.
5. Clinical Responsibility
Providers using Spectrayan are solely responsible for the clinical care they deliver. The platform is a practice management and support tool — it does not establish a provider-client relationship between Spectrayan and any client. All treatment decisions, documentation, and compliance with applicable healthcare regulations remain the responsibility of the provider.
6. Data Ownership
You retain ownership of all data you enter into the platform, including clinical notes, treatment plans, and client information. Spectrayan does not claim ownership of your content. We use your data only as described in our Privacy Policy and as necessary to provide the services.
7. Multi-Tenant Architecture
Spectrayan operates a multi-tenant architecture where each organization's data is logically isolated. Tenant administrators are responsible for managing user access within their organization. Spectrayan ensures that data from one tenant is not accessible to another.
8. Service Availability
We strive to maintain high availability of the platform but do not guarantee uninterrupted access. We may perform scheduled maintenance, updates, or experience downtime due to circumstances beyond our control. We will make reasonable efforts to notify users of planned maintenance in advance.
9. Subscription and Payment
Access to certain features may require a paid subscription. Payment terms, pricing, and billing cycles will be communicated at the time of subscription. Failure to maintain payment may result in reduced access to premium features. Refund policies will be outlined in your subscription agreement.
10. Termination
You may close your account at any time by contacting us. Spectrayan reserves the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or pose a risk to other users or the platform. Upon termination, your data will be handled in accordance with our Privacy Policy.
11. Limitation of Liability
To the maximum extent permitted by law, Spectrayan shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. This includes, but is not limited to, damages arising from clinical decisions made using AI-generated content, data loss, or service interruptions.
12. Indemnification
You agree to indemnify and hold Spectrayan harmless from any claims, damages, or expenses arising from your use of the platform, violation of these terms, or infringement of any third-party rights.
13. Changes to These Terms
We may update these Terms and Conditions from time to time. When we make significant changes, we will notify you via email or through a notice on the platform. Continued use of the platform after changes take effect constitutes acceptance of the updated terms.
14. Governing Law
These terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these terms or your use of the platform shall be resolved through good-faith negotiation, and if necessary, binding arbitration.
